2. Applicability
These Terms and Conditions apply to all offers, orders, and agreements between POODL.® and consumers.
3. Offers and Agreement
3.1. All offers are non-binding unless stated otherwise.
3.2. An agreement is concluded when the order confirmation has been sent by email.
4. Prices and Payment
4.1. All prices are stated in EUR and include VAT, unless stated otherwise.
4.2. Payment must be completed in full before delivery.
4.3. Obvious pricing errors may be corrected.
5. Delivery
5.1. Products are delivered to the address provided by the customer.
5.2. Delivery times are indicative.
5.3. Delays do not automatically entitle the customer to compensation.
6. Right of Withdrawal
6.1. Consumers have the right to withdraw from the agreement within 14 days after receiving the product, without giving any reason
6.2. After withdrawal, the product must be returned within 14 days.
6.3 The item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase.
6.4. The purchase amount will be refunded within 14 days after receipt of the returned product.
Exceptions
The right of withdrawal does not apply to:
- On sale items or gift cards;
- Custom-made or personalized products;
- Sealed products that are not suitable for return for hygiene reasons and where the seal has been broken.
7. Legal Warranty
7.1. Products must comply with the agreement and meet reasonable expectations.
7.2. Consumers are entitled to the statutory warranty under Dutch and European law.
8. Liability
8.1. Our liability is limited to direct damages only.
8.2. Liability shall never exceed the amount paid for the relevant order.
8.3. This limitation does not apply in cases of intent or gross negligence.
9. Complaints
9.1. Complaints must be submitted within a reasonable time after discovery.
9.2. We aim to respond within 14 days.
10. Governing Law and Disputes
10.1. These Terms are governed by Dutch law.
10.2. Disputes may be submitted to the competent court in the Netherlands.
10.3. Consumers may also bring disputes before the court of their place of residence.
